Governor Jay Inslee Announced That He Would Rescind Two Proclamations Related to the COVID-19 Pandemic That May Impact LTC

Governor Jay Inslee announced that he would rescind a couple of proclamations related to the COVID-19 pandemic that may impact long-term care.  The two proclamations being rescinded are:

Proclamation 20-30, which suspends statutory job search requirements for applicants seeking unemployment insurance. This rescission is effective July 4.

This means in order to remain eligible for unemployment benefits, individuals will be required to look for work and document:

  • At least three approved job search activities each week if you are receiving regular unemployment insurance benefits or Pandemic Emergency Unemployment Compensation (PEUC). 
  • At least one approved job search activity each week if you are receiving Pandemic Unemployment Assistance (PUA).

Proclamation 20-46, which provides protections for high-risk workers, has been substantially replaced by Engrossed Substitute Senate Bill (ESSB) 5115 and was made immediately effective. This new law, which was signed and made effective immediately, is known as the Health Emergency Labor Standards Act (HELSA), which applies to workplaces only during a declared public health emergency involving an infectious or contagious disease. The law includes protections for high-risk employees from discrimination during public health emergencies. Information about these protections is available hereThis rescission is effective June 28.

As a reminder, ESSB 5115 (HELSA) covers frontline employees, including maintenance, janitorial, and food service workers at any facility treating patients diagnosed with COVID. The definition is vague but is believed to apply to a nursing home, assisted living facility, or other facilities that treat COVID. It does not apply to your health care workers who are covered under ESSB 5190.
