Changes to Employer Requirements for Providing Wage and Salary Information to Applicants 

Governor Inslee has recently signed SB 5761 into law, which will require employers with more than 15 employees to include a salary or pay range and information about other compensation and benefits in their job postings. The current law only requires employers to provide a minimum wage or salary after an offer has been made to the applicant. Lawmakers believe this change will make it easier for women and people of color to negotiate better starting salaries and to increase transparency for prospective job seekers. 

Specifically, employers will need to disclose in all job postings a wage scale or wage range and “all of the benefits and other compensation to be offered” in connection with the position, regardless of the applicant’s request. 

“Posting” means “any solicitation intended to recruit job applicants for a specific available position, including recruitment done directly by an employer or indirectly through a third party, and includes any postings done electronically, or with a printed hard copy, that includes qualifications for desired applicants.” 

When an employee does an internal transfer, the current law applies that upon request of an employee offered an internal transfer to a new position or promotion, provide the wage scale or salary range for the employee’s new position. 

The new law goes into effect on January 1, 2023.
