LeadingAge National submitted a response to the draft HCBS Access Act, proposed by Sens. Brown, Casey and Hassan and Rep. Dingell, under which the Medicaid HCBS would be mandatory benefits with 100% FMAP and a singular functional eligibility criteria. LeadingAge is generally supportive of the Act but provides feedback on how to improve the bill (e.g., more aggressive rate setting oversight, inclusion of PACE, operational considerations re: functional eligibility determination) and recommendations on how to protect nursing homes under this framework. The letter is here. If passed this type of legislation could bring welcome change and growth to all HCBS settings.
