DSHS Files the Permanent Rule to Add Medication Assistance to ADLs

Dear Assisted Living Facility Administrator:

This message is to announce the filing of a CR-103 (Permanent Rule) amending Chapter 38878A WAC of the assisted living facility licensing rules. The Department is amending these rules as required by federal or state law or required to maintain federally delegated or authorized programs; and to assure compliance with requirements from 2016-2017 passed legislation SHB 1671.

Public hearings were held on October 9, 2018 and November 27, 2018. RCS received one comment regarding the proposed changes for clarification and a recommendation for the Disclosure of Services form to reflect this change.

The department filed the CR-103P permanent rules (WSR 19-07-033) on March 13, 2019. The permanent rule will become effective on April 14, 2019.

The scope of changes in rulemaking was to add medication assistance to activities of daily living. The permanent rule won’t appear online for at least two weeks after the full text of the rule is published in the Washington State Register.
