DOL Inspector General Calls for Binding COVID-19 Workplace Standard 

The Department of Labor’s Inspector General issued a report today that recommends that OSHA improve its inspection strategy by prioritizing very high and high-risk employers for COVID-19 onsite inspections; ensure inspections are tracked retroactive to February 1, 2020; compare remote inspections to onsite inspections; and determine whether establishing an infectious disease specific Emergency Temporary Standard (ETS) is necessary as employees return to worksites.  If OSHA replaces its current guidance (under an executive order) with an ETS, employers would be legally obligated to comply with it.
